Wits University, in cooperation with PMSA’s Emerging Project Managers Group invites you to a Public Lecture by Benjamin Tymann titled 'Legal Risks in the Global Construction Industry and Designing an Effective Compliance Programme to Address Them'. ABOUT THE SPEAKER Benjamin Tymann is a partner at the international law firm Greenberg Traurig, where he co-chairs the Global Construction Materials practice group. Ben has represented construction, materials and mining companies in the U.S. and globally. A former government regulator and U.S. Army officer, Ben focuses his practice in the areas of corporate compliance and risk mitigation programs, internal corporate investigations, and defending companies in governmental and regulatory investigations in the U.S. and across the globe. Ben’s anti-corruption compliance work on behalf of multinational companies brings him regularly to sub-Saharan Africa, where he has spent approx. 50% of his time in the past year. He received his Bachelor’s degree from Boston University and his law degree from Suffolk University Law School. ABOUT THE TALK There are few industries that interact as regularly with government officials than the construction industry. Whether it’s securing a tender, obtaining a permit, or undergoing an inspection, the work of construction professionals frequently intersects with that of public officials. These day-to-day relationships with government can create a host of regulatory risks and, at times, ethical dilemmas implicating serious civil and criminal laws if the interactions are not handled properly. Because operating in the construction sector brings this high level of risk, responsible companies are welladvised to make an effective compliance programme a top priority. By doing so, companies gain a dual benefit: sending the right message internally and externally about their commitment to ethical behaviour; and owning a proactive programme to prevent compliance problems or, at least, to contain them before they become damaging and costly distractions. This presentation will focus on (1) understanding the current landscape of key legal and enforcement risks for multinational construction companies operating in Africa; and (2) designing an effective compliance programme that successfully deters or detects the kind of potential wrongdoing that, if permitted to fester,can jeopardize your company’s future.
